In March 2022, Miami-Dade County passed an ordinance which changes the process for a landlord to raise rent and terminate month to month tenancies.
If a landlord wants to terminate a month to month tenancy, the landlord is required to serve 60 days’ notice on the tenant. Additionally, if a landlord wants to raise rent above 5%, the landlord must serve written notice on the tenant, giving at least 60 days’ notice of the intent to increase rent above 5%. If the landlord fails to deliver the notice, the landlord cannot raise the rent and cannot evict the tenant based on the newer amount of rent.
This ordinance only applies to Miami-Dade County as of the date of this posting.
