Florida’s eviction restrictions enacted under Executive Order 20-180 on April 2, 2020 and extended five separate times have now expired effective October 1, 2020. The relief was permitted to expire to avoid any confusion over whether the CDC’s evictions order should apply in a particular circumstance.

The Centers for Disease Control and Prevention (CDC) issued an order on September 2, 2020 which halts certain types of evictions where a CDC affidavit is served on a landlord or in court through December 31, 2020. Now landlords will be required to operate under one set of eviction restrictions at the federal level, instead of trying to navigate competing eviction restrictions at the state level as well.

In the meantime The National Apartment Association (NAA) has joined a federal lawsuit challenging the CDC order and we will provide updates as we get them.
